1. Scope

These General Terms and Conditions apply to all orders placed through our online shop and to all related services provided by SCL&DG Labs GmbH.

Our offer is directed at consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person, or a partnership with legal capacity, acting in the exercise of their trade, business or profession when entering into a legal transaction.

Deviating, conflicting or supplementary general terms and conditions of the customer do not become part of the contract unless we expressly agree to their validity.

3. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

You can place products in the shopping cart without obligation and correct your entries at any time before submitting the order. By clicking the order button, you submit a binding offer to purchase the goods contained in the shopping cart.

We may accept your order by express order confirmation, by shipping confirmation or by delivery of the goods. An automatically sent confirmation of receipt initially only confirms receipt of your order unless it expressly declares acceptance of the order.

We reserve the right to reject or cancel orders for objective reasons, in particular if a product is unavailable, obvious price or product information was incorrect, there is suspicion of misuse or fraud, or legal reasons prevent fulfilment. Payments already made will be refunded without delay in this case.

4. Products, product information and usage instructions

We sell functional pouches, energy pouches, caffeinated products, caffeine-free products, food supplements and comparable consumer products.

Before use, please always observe the respective product information, ingredients lists, recommended intake, warnings, dosage recommendations and instructions on the product packaging and on the respective product page.

If products contain caffeine or other functional ingredients, they may not be suitable for children, pregnant or breastfeeding persons, or people who are sensitive to caffeine or certain ingredients. Food supplements are not a substitute for a balanced and varied diet and a healthy lifestyle.

5. Prices, shipping costs and payment

All prices stated in the online shop include statutory VAT where applicable and exclude shipping costs unless stated otherwise.

Shipping costs are shown during the ordering process. The payment methods available are displayed in the checkout.

6. Delivery

Delivery times, shipping methods and shipping restrictions can be found in our shipping policy and in the information shown during checkout.

If a product is temporarily unavailable, we will inform you as soon as possible. Statutory rights remain unaffected.

7. Right of withdrawal and returns

Consumers have the statutory right of withdrawal. Details can be found in our withdrawal instructions and our returns and refund policy.

For hygiene and health protection reasons, opened, used or unsealed products may be excluded from return if their product-related seal has been opened, removed or damaged.

8. Retention of title

The goods remain our property until full payment has been made.

9. Warranty

The statutory warranty rights apply.

10. Liability

We are liable without limitation for damages arising from injury to life, body or health, for intent and gross negligence, under the Product Liability Act and where we have expressly assumed a guarantee.

In cases of slight negligence, we are liable only for breach of material contractual obligations, limited to foreseeable damage typical for the contract. Further liability is excluded to the extent permitted by law.

11. Promotional campaigns, vouchers and discounts

Promotional campaigns, vouchers and discounts are voluntary offers and may be subject to separate conditions, validity periods, minimum order values or product exclusions. Unless stated otherwise, discounts cannot be combined or paid out in cash.

12. Customer account

If you create a customer account, you are responsible for keeping your access data confidential and for providing accurate information. You can request deletion of your account unless statutory retention obligations prevent this.

13. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and have your habitual residence in another country, mandatory consumer protection provisions of that country remain unaffected.
